Drawing up of the Law on Protection of Heritage in Bosnia and Herzegovina

 

Activities regarding the preparation of legal and institutional framework for protection of heritage in Bosnia and Herzegovina are realized within the Project on Expanding of Effectiveness of the Institutions in Bosnia and Herzegovina, being one of three integral parts of the Regional Programme for Cultural and Natural Heritage in the South-Eastern Europe 2003-2005, prepared by the European Council. The Commission supports the Regional Programme for Cultural and Natural Heritage in the South-Eastern Europe, and being the only institution responsible for protection of heritage established in Bosnia and Herzegovina, it has an obligation of representing the interests of Bosnia and Herzegovina, in order for the specific needs of our country to be satisfied during the implementation of the Programme. The European Council has appointed a member of the Commission, Ms. Amra Hadžimuhamedović, a Programme Coordinator in Bosnia and Herzegovina, whereas the Commission proposed Mr. Dubravko Lovrenović as a Project Coordinator of this part of the Programme.

 

Preparation of legal and institutional framework has as its aim expanding of effectiveness of the Institutions in implementation and coordination of complex development projects, as well as affirmation of the heritage, as an aspect of continual social and business development, all with respect to the identity of ethnic groups of Bosnia and Herzegovina.

 

Passing of Law on Protection of Heritage in Bosnia and Herzegovina should provide a legal framework for protection of heritage on the governmental level, as well as the means for its implementation, all in accordance with standards, regulations, and directives of the European Council, European Union, and Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina. 

 

On the initiative of the Commission, and in accordance with the resolutions passed on the meetings with the Entities' Ministries responsible for space planning and culture, expert Working Group was constituted for drawing up of draft of the proposed Law on Protection of Heritage of Bosnia and Herzegovina, which will operate within the Commission to Preserve National Monuments. The Working Group will number one representative from the following bodies:

            - the Ministry of Civil Affairs of Bosnia and Herzegovina;

            - the Federation of B&H Ministry of Culture and Sports;

            - the Federation of B&H Ministry of Space Planning and Environment;

- the Ministry of Space Planning, Civil Engineering and Ecology of Republika Srpska;

            - the Ministry of Education and Culture of Republika Srpska;

- the Government of Brčko District in Bosnia and Herzegovina, Department for Town Planning;

            - non-governmental organizations for protection of cultural heritage;

            - the Commission to Preserve National Monuments.

 

            The following members were appointed to make the Working Group:

1. Dr Dubravko Lovrenović, the Commission to Preserve National Monuments;

2. Srđan Arnaut, the Ministry of Civil Affairs of Bosnia and Herzegovina;

3. Dr Sabira Husedžinović, the Federation of B&H Ministry of Culture and Sports;

4. Gordana Vilušić, the Federation of B&H Ministry of Space Planning and Environment;

5. Maida Ibrišagić, Ministry of Space Planning, Civil Engineering and Ecology of Republika Srpska

6. Zoran Mačkić, Archives of Republika Srpska (the representative of the Ministry of Education and Culture of Republika Srpska);

7. Gordana Lukić, the Government of Brčko District, Department for Property Affairs;

8. Dr Enes Milak, Society for protection of Natural and Historical Values of Jajce Municipality.

 

Preceding activities related to the Project on Expanding of Effectiveness of the Institutions in Bosnia and HerzegovinaDrawing up of the Law on Protection of Heritage, which will be implemented on the governmental level:

-         Visit by Robert Pickard, a member of the Working Group for legal support, operating within the Programme of Technical Cooperation and Assistance of the European Council, expert for legislation in the field of protection of heritage, Sarajevo, on 17th and 18th February 2004;

-         First meeting of the Working Group for drawing up of the Law on Protection of Heritage of Bosnia and Herzegovina, Sarajevo, on 25th March 2004;

-         Second meeting of the Working Group for drawing up of the Law on Protection of Heritage of Bosnia and Herzegovina, Banja Luka, 8th April 2004.
