Status of monument -> National monument

Pursuant
to Article V para. 4 Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina
and Article 39 para. 1 of the Rules of Procedure of the Commission to Preserve
National Monuments, at a session held from 9 to 15 September 2008 the
Commission adopted a
D E C I S
I O N
I
The
residential architectural ensemble of the Behmen family in Stolac is
hereby designated as a National
Monument of Bosnia and Herzegovina
(hereinafter: the National Monument).
The
National Monument consists of two residential complexes – Hatidža Behmen's
residential complex and hajji Salih Behmen's residential complex – located on a
site designated as cadastral plot nos. 165, 166, 167 and 168, cadastral municipality
Stolac, Stolac Municipality, Federation of Bosnia and Herzegovina, Bosnia and
Herzegovina.
The
provisions relating to protection measures set forth by the Law on the
Implementation of the Decisions of the Commission to Preserve National
Monuments, established pursuant to Annex 8 of the General Framework Agreement
for Peace in Bosnia and Herzegovina (Official Gazette of the Federation of BiH
nos. 2/02, 27/02, 6/04 and 51/07) shall apply to the National Monument.
II
The
Government of the Federation of Bosnia and Herzegovina (hereinafter: the
Government of the Federation) shall be responsible for providing the legal,
scientific, technical, administrative and financial measures necessary for the
protection, conservation, restoration and presentation of the National
Monument.
The
Commission to Preserve National Monuments (hereinafter: the Commission) shall
determine the technical requirements and secure the funds for preparing and
setting up signboards with basic details of the monument and the Decision to
proclaim the property a National Monument.
III
To ensure
the ongoing protection of the National Monument, the following protection
measures are hereby stipulated, which shall apply to the area defined in
Clause 1 para. 2 of this Decision:
-
all works are prohibited
other than rehabilitation, conservation and restoration works and works
designed for the presentation of the monument;
-
a rehabilitation project
shall be drawn up to cover the conservation and restoration of the
architectural ensemble and of the various components within the ensemble, and
the reconstruction of missing parts in their original shape and size, of the
original or the same type of material and using the same techniques wherever
possible. All methods and interventions must be identifiable, and may be
carried out solely on the basis of approved documentation;
-
to protect the property
and ensure the conditions for its rehabilitation, two stages of works are
hereby prescribed:
Stage I – emergency
protection from further deterioration:
1. a detailed
survey of the current condition,
2. conservation
of the walls,
3. dismantling
fallen parts, and marking and identifying them,
4. repair
and structural consolidation of the walls.
Stage II–
rehabilitation of the complex:
1. draw
up a reconstruction and restoration project based on available photographs and
architectural drawings and blueprints of the condition of the properties,
2. as
part of the project, resolve all parts for which there is no reliable
documentation in such a way as to ensure their interpolation will be
identifiable.
-
the original use of the
properties shall be retained as far as possible. By way of exception, changes
of use for catering, educational or cultural purposes in such a way as shall
not be detrimental to the architectural ensemble shall be permitted;
-
all works on the National
Monument shall be carried out on the basis of approval from the Federal
ministry responsible for regional planning and under the expert supervision of
the heritage protection authority of the Federation of Bosnia and Herzegovina;
-
the courtyard and garden
shall be landscaped and planted up using indigenous plant species;
-
a programme for the
presentation of the National Monument shall be drawn up and implemented;
-
a project to floodlight
the National Monument shall be drawn up and implemented;
-
on plots c.p. 156, 157,
158, 159, 160, 161, 162, 163, 164, 169, 170, 171, 172, 173, 174, 175, 176, 177,
178, 179, 180, 181, 182, 183, 184, 185, 186, 187, 188, 189, 190, 191, 192, 193,
194, 208, 209, 212 and 213, c.m. Stolac, bordering on the protected site, the
construction of new properties and changes to the size and height of existing
ones are prohibited; remedial work and the adaptation of existing properties is
permitted subject to retaining the existing size in plan and height (all
properties on which repair and adaptation works are carried out must respect
the building line of neighbouring properties at ground and upper floor levels);
the proportions and colour schemes of the properties may not clash with properties
of townscape value; the erection of advertising hoardings, posters or signs
that could be detrimental to the overall appearance of the architectural
ensemble, of the individual properties within it, and the surroundings, is
prohibited.
IV
All
executive and area development planning acts not in accordance with the
provisions of this Decision are hereby revoked.
V
Everyone,
and in particular the competent authorities of the Federation of Bosnia and
Herzegovina, the Canton, and urban and municipal authorities, shall refrain
from any action that might damage the National Monument or jeopardize the
preservation thereof.
VI
The
Government of the Federation, the Federal Ministry responsible for regional
planning, the Federation heritage protection authority, and the Municipal
Authorities in charge of urban planning and land registry affairs, shall be
notified of this Decision in order to carry out the measures stipulated in
Articles II to V of this Decision, and the Authorized Municipal Court shall be
notified for the purposes of registration in the Land Register.
VII
The
elucidation and accompanying documentation form an integral part of this
Decision, which may be viewed by interested parties on the premises or by
accessing the website of the Commission (http://www.aneks8komisija.com.ba)
VIII
This
Decision shall enter into force on the day following its publication in the
Official Gazette of BiH.
This
Decision has been adopted by the following members of the Commission: Zeynep

Ševo.
