Pursuant to Article V para. 4 Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina and Article 39 para. 1 of the Rules of Procedure of the Commission to Preserve National Monuments, at a session held from 16 to 22 January 2007 the Commission adopted a
D E C I S I O N
I
The cemetery ensemble of the old burial ground in Kovači in Sarajevo is hereby designated as a National Monument of Bosnia and Herzegovina (hereinafter: the National Monument).
The National Monument is located on a site designated as cadastral plot no. 96, mahala LXXVII (old survey), corresponding to c.p. no. 125 (newsurvey), c.p. no. 3, mahala LXXX, c.p. no. 79, mahala XCVI (old survey), corresponding to c.p. nos. 2403 and 2405 (new survey), c.p. no 4, mahala XCVII (old survey), corresponding to c.p. no. 2463 (new survey), c.p. no. 9, mahala XCVII (old survey), corresponding to c.p. no. 2543 (new survey), cadastral municipality Sarajevo, Municipality Stari Grad, Federation of Bosnia and Herzegovina, Bosnia and Herzegovina.
The provisions relating to protection measures set forth by the Law on the Implementation of the Decisions of the Commission to Preserve National Monuments, established pursuant to Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina (Official Gazette of the Federation of BiH nos. 2/02, 27/02 and 6/04) shall apply to the National Monument.
II
The Government of the Federation of Bosnia and Herzegovina (hereinafter: the Government of the Federation) shall be responsible for ensuring and providing the legal, scientific, technical, administrative and financial measures necessary to protect, conserve, and display the National Monument.
The Government of the Federation shall be responsible for providing the resources needed to draw up and implement the necessary technical documentation for the presentation of the National Monument.
The Commission to Preserve National Monuments (hereinafter: the Commission) shall determine the technical requirements and secure the funds for preparing and setting up signboards with the basic data on the monument and the Decision to proclaim the property a National Monument.
III
To ensure the on-going protection of the National Monument, the following protection measures are hereby stipulated, which shall apply to the area defined in Clause 1 para. 2 of this Decision.
- all works are prohibited other than conservation and restoration works, including works designed to display the monument, with the approval of the Federal Ministry responsible for regional planning and under the expert supervision of the heritage protection authority of the Federation of Bosnia and Herzegovina (hereinafter: the heritage protection authority).
IV
All executive and area development planning acts not in accordance with the provisions of this Decision are hereby revoked.
V
Everyone, and in particular the competent authorities of the Federation of Bosnia and Herzegovina, the Canton, and urban and municipal authorities, shall refrain from any action that might damage the National Monument or jeopardize the preservation thereof.
VI
The Government of the Federation, the Federal Ministry responsible for regional planning, the Federation heritage protection authority, and the Municipal Authorities in charge of urban planning and land registry affairs, shall be notified of this Decision in order to carry out the measures stipulated in Articles II to V of this Decision, and the Authorized Municipal Court shall be notified for the purposes of registration in the Land Register.

VIII
Pursuant to Art. V para 4 Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina, decisions of the Commission are final.
IX
This Decision shall enter into force on the date of its adoption and shall be published in the Official Gazette of BiH.

I – INTRODUCTION
Pursuant to Article 2, paragraph 1 of the Law on the Implementation of the Decisions of the Commission to Preserve National Monuments, established pursuant to Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina, a “National Monument” is an item of public property proclaimed by the Commission to Preserve National Monuments to be a National Monument pursuant to Articles V and VI of Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina and property entered on the Provisional List of National Monuments of Bosnia and Herzegovina (Official Gazette of BiH no. 33/02) until the Commission reaches a final decision on its status, as to which there is no time limit and regardless of whether a petition for the property in question has been submitted or not.
The old burial ground in Kovači lies within the Urban townscape ensemble of Sarajevo, which by decision of the Commission is on the Provisional List of National Monuments under serial no. 546.
Pursuant to the provisions of the law, the Commission proceeded to carry out the procedure for reaching a final decision to designate the Property as a National Monument, pursuant to Article V para. 4 of Annex 8 and Article 35 of the Rules of Procedure of the Commission to Preserve National Monuments.
II – PROCEDURE PRIOR TO DECISION
In the procedure preceding the adoption of a final decision to proclaim the property a national monument, the following documentation was inspected:
- Data on the current condition and use of the property, including a description and photographs, data of war damage, data on restoration or other works on the property, etc.
- Documentation on the location and current owner and user of the property (Municipality Stari Grad Sarajevo: copy of cadastral plan and copy of land register entry)
- Historical, architectural and other documentary material on the property, as set out in the bibliography forming part of this Decision.
The findings based on the review of the above documentation and the condition of the site are as follows:
1. Details of the property
Location
The old Muslim burial ground is in the quarter known as Kovači, which is about 500 m to the south-east of the square in Baščaršija. The burial ground covers a number of plots:
Plot 1. – burial ground of Nadkovači
This plot is on the western side of the Kovači plateau, and consists of a trapezoidal area bounded by Kovači street to the south and Patke street (formerly Trifko Grabež street) to the north. The plot is on c.p. no. 96, mahala LXXVII (old survey), corresponding to c.p. no. 125 (new survey, c.m. Sarajevo, Municipality Stari Grad, Sarajevo.
Plot 2. – burial ground alongside Halilbašić street
This plot is on the southern part of the Kovači plateau, about 300 m to the east of plot 1. It is bounded by Halilbašić and Jekovac streets, on c.p. no. 4r, mahala XCVII (old survey), corresponding to c.p. no. 2463 (new survey), c.m. Sarajevo, Municipality Stari Grad, Sarajevo.
Plot 3. – burial ground between Ploča and Širokac streets
This plot is very close to the Vratnik gatehouse and Mišćina mosque, on c.p. no. 3, mahala LXXX, c.p. no. 79, mahala XCVI (old survey), corresponding to c.p.. nos. 2403 and 2405 (new survey), c.m. Sarajevo, Municipality Stari Grad, Sarajevo, and the plot alongside Jekovac street, on c.p. no. 9, mahala XCVII (old survey), corresponding to c.p. no. 2543 (new survey), c.m. Sarajevo, Municipality Stari Grad, Sarajevo.
Historical information
There are numerous burial grounds in Sarajevo, representing complex spiritual symbols of the past and of the passage of time. They have for centuries formed part of the urban spatial culture and have gained the status of monuments of sepulchral art(1). By the time the Austro-Hungarian authorities took over the administration of the region, Sarajevo had at least 270 Muslim burial grounds(2).
A summary census of the Bosnian Sandžak dating from 1515-16 makes reference to Mahala Mekabir, the Burial Ground mahala(3). Research by H. Šabanović, later published in his work on the origins and development of Sarajevo, led to the hypothesis that this was the mahala located on the plateau above the right bank of the river Miljacka through the centre of which runs Nadmlini street – in short, that mahala Mekabir was in fact Kovači mahala. If this is so, the burial ground in Kovači is one of the oldest in Sarajevo, dating from the 14th century(4).
The appearance, size and shape of the nišan tombstones and the level of workmanship they reveal may also suggest this. This is true in particular of plot 1, where a number of very ancient nišan tombstones have survived. Their features, primarily their size and formal elements, date them to the 15th century, to the earliest years of Ottoman rule in this part of the world.
The old burial ground in Kovači originally extended from Nadmilini street to the south towards Jekovac and Žuta Tabija (yellow bastion) to the east, the towers in Širokac and Ploča to the north east, to Saburina street. To the west, the burial ground ran almost all the way down to Baščaršija. It consisted of nine plots intersected by footpaths. As many as four plots have been exhumed, but only a few nišan tombstones have been tranferred to the burial ground in Grlića Brdo.
There are now more than 200 nišan tombstones, compared with more than 400 previously. Of these, 165 have epitaphs. The oldest tombstone with an epitaph dates from 1548, and the most recent from 1878.
In 1964, burial grounds were turned into park areas with paths. In the 1970s a sports centre was built on the eastern most part of the burial ground, below the wall linking the gatehouses in Širokac and Ploča, south of Saburina street. There were some graves surrounded by their own wooden barrier on this plot, belonging to the standard-bearers Kandelija and Geljlan Rizvan, who took part in the battle of Banja Luka against Austrian troops in 1150 AH and who died in 1196 AH (1782)(5). The memory of these two standard-bearers has also been preserved in a folk song (Mujezinović, pp. 141-142). Until just before World War II candles were still being lit on the graves of these heroes as a mark of respect.
A comparison between the burial ground as it is now and as it was when studied by Mustafa Mujezinović in 1964 reveals that a great many of the nišan tombstones have disappeared. The exceptions are plots 1 and 2. When the sports ground was built, some of the tombstones were built into the wall linking the gatehouses of Ploča and Širokac, but it is not known what happened to most of them. In 2004 the complex was fenced off and a retaining wall was built.
Although much of the complex is derelict, the remaining nišan tombstones reveal the development of Islamic tombstone architecture in Sarajevo. The epitaphs on the nišan tombstones provide extensive information on the families living in the surrounding mahalas.
2. Description of the property
Plot 1.
The plot measures approx. 50 x 20 metres. On account of the sloping terrain, there is a stone wall to the south and north sides, which is more than 2 metres in height in places. Access to the plot is from the east, via steps. According to Mujezinović, there was a separate grave with its own railings outside this plot, known to the locals as Karača's mezar(6).
When the road was widened at this point the grave was exhumed and the mortal remains were moved to Grlića brdo, together with the nišan tombstones.
The plot has a total of 35 nišans of which some have turbans and no epitaph. Some of them appear to have been added later (during the most recent interventions by the Cantonal Institute for the Protection of Monuments, in addition to making good certain of the tombstones, those that had sunk into the ground were set upright again).
The nišan tombstones on this site are of transitional form from the mediaeval tombstones, and do not yet feature turbans. A surviving local tradition ascribes them to the Ottomans killed during the conquest of the region. Among their typical features are their size and the roughly-worked stone (a roughly carved obelisk topped by a hemisphere, the oldest shape for a nišan tombstone), and the decorative elements, corresponding to the decorations seen on mediaeval stećak tombstones – an arm to the elbow, a hand, bow and arrow, a knobbed staff, a sword, a sabre, and the common motifs of a crescent moon and hemisphere, often together. Another typical feature of these tombstones is that the headstone and footstone are set markedly far apart – in some cases, as much as 3 or 4 metres. All the nišan tombstones are made of hreša (local Sarajevo stone). None bears an epitaph..
Until 1946 this plot contained the nišan tombstone of one Turalija, son of Hamza, which has been transferred to the lapidarium of the Gazi Husrev-beg library. Judging from the epitaph, this tombstone dates from 1552. The headstone is more than a metre in height, and 14 x 14 cm in section. It stood on a sarcophagus composed of stone slabs. The epitaph is in twelve rectangular panels, one of which is damaged.
Nišan no. 1
Nišan rectangular in section, measuring 34 x 28 cm, with a pyramidal top. The height of the nišan is 190 cm. A spiked club(7) and hemisphere are carved on the south-east side, a sabre on the north-west side, and a hemisphere on the south-west side. The nišan is made of Sarajevo hreša, and is partly damaged.
Nišan no. 2
Nišan in the form of a stela, rectangular in section measuring 47 x 23 cm with a height of 150 cm. A sabre is carved on the nišan. The top of the nišan is broken.
Nišan no. 3
Nišan in the form of a stela rectangular in section 50 x 22 cm with a height of 190 cm. A crescent moon is carved on the front (north-east side) of the nišan, and hemispheres on the right and left hand sides.
Nišan no. 4
Nišan rectangular in section measuring 48 x 22cm with a height of 150 cm. The nišan bears the same designs as nišan no. 3. This one is probably the footstone to no. 3.
Nišan no. 5
Man’s headstone nišan with folded turban, without inscription. The nišan measures 29 x 24 cm in section and is 210 cm in height.
Nišan no. 6
Man’s nišan with turban, without epitaph. The nišan measures 17 x 18 cm in section and is 88 cm in height. This nišan is of more recent date than the others in this part of the burial ground.
Nišan no. 7
Man’s nišan with turban, without epitaph, measuring 17 x 16 x 75 cm. Of more recent date.
Nišan no. 8
Nišan in the shape of a stela, rectangular in section 55 x 15 cm with a height of 130 cm. The triangular top of the nišan is carved with three hemispheres joined by a straight line, with the central hemisphere at the top of the nišan.
Nišan no. 9
Man’s nišan with folded turban, without epitaph, square section of 24 x 24 cm with a height of 140 cm. A zigzag linen is incised below the neck of the turban, suggesting that the deceased was a hajji. The nišan is damaged, and has a stone surround measuring 320 x 195 cm.
Nišan no. 10
Grave site with a stone surround measuring 270 x 153 cm, on which there is a broken footstone nišan.
Nišan no. 11
Nišan of octagonal section, with a stone surround measuring 275 x 120 cm. The sides of the octagon are 11 cm wide and the nišan is 65 cm in height.
Nišan no. 12
Broken nišan measuring 13 x 14 cm. The height above ground is 23 cm. The nišan has a stone surround measuring 255 x 110 cm.
Nišan no. 13
Man’s nišan with aga's turban, without epitaph, carved with a sabre. The nišan measures 21 x 22 cm in section and is 155 cm in height. The grave has a stone surround measuring 285 x 115 cm.

Old broken nišan with carved crescent moon and sphere. Rectangular in section, measuring 58 x 24 cm. The surviing part is 140 cm in height. According to Hazim Numanagić, this could be the footstone nišan to nišan no. 15.
Nišan no. 17
Man’s nišan, without epitaph, with folded turban and carved staff, rectangular in section measuring 23x17 cm with a height of 95 cm.
Nišan no. 18

This plot contains about twenty nišan tombstones, the majority of which appeare to have been brought to this part of the burial ground and erected here, or to have been found lying on the ground and re-erected. This part of the burial ground contains the following nišans:

Plot 3 – Area west of the Širokac and Ploča gatehouses
In size, plot 3 is the largest in the Kovači burial ground. It is located between Kovači and Širokac streets, to the north of the new shahid's burial ground, and is divided by footpaths into two plots(8). The first, lower plot has more than 120 nišan tombstones, more than thirty of them with epitaphs.
The nišans with epitaphs date from the late 18th and the 19th century. It is mainly members of the Džino family who are interred in this part of the burial ground. There are about fifteen children's nišan tombstones in the upper part of the plot, towards Širokac street.
Nišan no. 1.
Man’s nišan with čatal turban(9), measuring 22.5 x 21 cm in section. The nišan is 135 cm in height. The epitaph is carved in eight lines in nasta'liq script.

Nišan in the form of a stela, rectangular in section measuring 30 x 16 cm with a height of 135 cm. The partly illegible epitaph is in nasta'liq Arabic script. The grave has a stone surround measuring 112 x 210 cm.

The footstone nišan, also in the shape of a stela, measuring 33 x 13 cm with a height of 112 cm, bears an illegible epitaph in naskh script, on which all that can be deciphered is the year 1276 (1859/60). This nišan has obviously been erected here later.

3. Legal status to date
The 1980 Regional Plan for Bosnia and Herzegovina lists the property as a Category I cultural and historical property (serial no. 10).
According to the Cantonal Institute for the Protection of Monuments, the Nadkovači burial ground was designated as a cultural monument. At the time this Decision was drafted the number of the ruling designating it was not available.
4. Research and conservation and restoration works
Research was begun by M. Mujezinović, who described the burial ground in 1964 and listed the epitaphs that could be deciphered. In 1964 the burial ground was turned into a park area.
After the 1992-1995 war, the war damage to plot no. 1 was made good. The work was led by the Cantonal Institute for the Protection of Monuments, Sarajevo.
In 2004 the retaining walls were repaired.
5. Current condition of the property
During an on-site inspection the following was ascertained:
- a comparison between the present state of the burial ground and that described by M. Mujezinović, revealed that many nišan tombstones are now missing. There are marked differences, particularly in that the number of plots now occupied by the burial ground has been much reduced
- it appears that carelessness on the part of the contractors working on the infrastructure in the immediate vicinity of the burial ground has led to some of the nišans being damaged. In 2004, during excavations for the gas lines in Vratnik, a bulldozer broke one nišan which has not yet been repaired
- in 2006 a works contractor on the site in the immediate vicinity of the Mišćina mosque using a bulldozer broke one nišan in half; it was then simply jammed into the ground (22)
- many nišan tombstones are sunken into the ground
- all the plots are kept regularly maintained, by being mown and cleared by the Cemetery Denoting Fund of Sarajevo Canton.
III – CONCLUSION
Applying the Criteria for the adoption of a decision on proclaiming an item of property a national monument (Official Gazette of BiH nos. 33/02 and 15/03), the Commission has enacted the Decision cited above.

(2) In 1888 the Austro-Hungarian authorities opened a new cemetery in the Koševo valley for Catholic and Orthodox burials. When the Jews came to Sarajevo in the 16th century a Jewish cemetery was formed on the northern slope of Mt. Trebević, in a place known as Borak.

(8) Mujezinović writes that there are three plots in this part of the burial ground. The third was lost when the sports centre was built.

(10) In his Islamska epigrafika Bosne i Hercegovine-I Mujezinović note (p. 15) Duda-hanum, daughter of hajji Mustafa-aga, wife of Talirević Avdaga, who passed away on 25 Dhu-l-Hijjah 1280, which according to Mujezinović corresponds to 06.06.1864.
(11) It is possible that this is the nišan referred to by Mujezinović on p. 155 of his book, except that he reads the father's name as Mustafa and says the grave has a surround. There is no surround to be seen now. The calculation of the date is wrongly given as 1876 in Mujezinović
