Pursuant to Article V para. 4 Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina and Article 39 para. 1 of the Rules of Procedure of the Commission to Preserve National Monuments, at a session held from 16 to 22 January 2007 the Commission adopted a

 

D E C I S I O N

 

I

 

The movable property of the archive holdings and collections of the Archives of Republika Srpska in Banja Luka is hereby designated as a National Monument of Bosnia and Herzegovina (hereinafter: the National Monument).

The National Monument consists of 24 archive holdings and collections

The National Monument is housed in the building of the Archives of Republika Srpska in Banja Luka, no. 1Aleja Svetog Save St.

The provisions relating to protection measures set forth by the Law on the Implementation of the Decisions of the Commission to Preserve National Monuments, established pursuant to Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina (Official Gazette of Republika Srpska no. 9/02) shall apply to the National Monument.

 

II

           

The Government of Republika Srpska shall be responsible for ensuring and providing the legal, scientific, technical, administrative and financial measures necessary to protect, conserve and display the National Monument.

 

III

 

The Government of Republika Srpska shall provide suitable physical and technical conditions for the safe-keeping of the National Monument.

  • procurement of equipment for the storerooms in which the material is housed,
  • procurement of the materials required to store the material (folders, sleeves, boxes),
  • provide suitable conditions for carrying out professional conservation and restoration of the archive material.

The display and other forms of presentation of the said collections in Bosnia and Herzegovina shall conform to the conditions stipulated by the ministry responsible for culture in Republika Srpska.

 

IV

 

Everyone, and in particular the competent authorities of Republika Srpska, and urban and municipal authorities, shall refrain from any action that might damage the National Monument or jeopardize the preservation thereof.

 

V

 

The removal of the entire collection or holdings or part(s) thereof (hereinafter: the movable heritage) from Bosnia and Herzegovina is prohibited.

By way of exception to the provisions of paragraph 1 of this Clause, the temporary removal from Bosnia and Herzegovina of the movable heritage for the purposes of display or conservation shall be permitted if it is established that conservation works cannot be carried out in Bosnia and Herzegovina.

Permission for temporary removal under the conditions stipulated in the preceding paragraph shall be issued by the Commission to Preserve National Monuments, if it is determined beyond doubt that it will not jeopardize the movable heritage in any way. 

In granting such permission, the Commission shall stipulate all the conditions under which the removal of the movable heritage from Bosnia and Herzegovina may take place, the date by which it shall be returned to the country, and the responsibility of individual authorities and institutions for ensuring that these conditions are met, and shall notify the Government of Republika Srpska, the relevant security service, the customs authority of  Bosnia and Herzegovina, and the general public accordingly.

 

VI

 

The Government of Republika Srpska, the Ministry responsible for regional planning in Republika Srpska and the heritage protection authority of Republika Srpska, and the Municipal Authorities in charge of urban planning and land registry affairs, shall be notified of this Decision in order to carry out the measures stipulated in Articles II – V of this Decision.

VIII

 

Pursuant to Art. V para 4 Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina, decisions of the Commission are final.

 

IX

 

This Decision shall enter into force on the date of its adoption and shall be published in the Official Gazette of BiH.

E l u c i d a t i o n

 

I – INTRODUCTION

 

Pursuant to Article 2, paragraph 1 of the Law on the Implementation of the Decisions of the Commission to Preserve National Monuments, established pursuant to Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina, a “National Monument” is an item of public property proclaimed by the Commission to Preserve National Monuments to be a National Monument pursuant to Articles V and VI of Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina  and property entered on the Provisional List of National Monuments of Bosnia and Herzegovina (Official Gazette of  BiH no. 33/02) until the Commission reaches a final decision on its status, as to which there is no time limit and regardless of whether a petition for the property in question has been submitted or not.

On 10 May 2004 the Archives of Republika Srpska in Banja Luka submitted a proposal to the Commission to designate the movable property of the archive holdings and collections housed in the Archives of Republika Srpska as a national monument of Bosnia and Herzegovina.

The Commission proceeded to carry out the procedure for reaching a final decision to designate the Property as a National Monument, pursuant to Article V para. 4 of Annex 8 and Article 35 of the Rules of Procedure of the Commission to Preserve National Monuments.

 

II – PROCEDURE PRIOR TO DECISION

 

In the procedure preceding the adoption of a final decision to proclaim the property a national monument, the following documentation was inspected:

  • Documentation of the Archives of Republika Srpska on the item under consideration.

The findings based on the review of the above documentation and the condition of the site are as follows:

Location

The archive holdings and collections of the Archives of Republika Srpska are housed in the building of the Archives of Republika Srpska in Banja Luka, no. 1 Aleja Svetog Save St.

Historical information

            The Archives of the Bosnian Krajina (frontier region) in Banja Luka were founded by resolution of the National Committee of the city of Banja Luka, no. 4735 of 20 April 1953, with the name Archives of the City of Banja Luka. Until then there had been no organized concern for the protection of archive material in north-western Bosnia.  Pursuant to approval by the Executive Council of NR BiH no. 1719-14of 30 May 1956, the archive material became the District Archives of Banja Luka, covering the districts of Banja Luka and Prijedor. In 1963 the Archives were granted extended scope, with its mandate covering the districts of Banja Luka and Bihać, and were renamed the Archives of the Bosnian Krajina.  In 1963 and 1964 three archive collection centres were set up on a regional basis, in Prijedor, Jajce and Bihać. From early 1967 to late 1973 founders' rights were exercised by the Assembly of SR BiH; on 1 January 1974, founders' and financing rights were taken over by the 23 municipalities of the Bosnian Krajina.

At that time the Archives consisted of the following units:

  1. Department for the classification and processing of archive material
  2. Section for the protection of the archive material and supervision of registry offices
  3. General affairs section.

Is territorial jurisdiction then covered the following 23 municipalities: Banja Luka, Bihać, Bosanska Dubica, Bosanska Gradiška, Bosansko Grahovo, Bosanska Krupa, Bosanski Novi, Bosanski Petrovac, Cazin, Čelinac, Drvar, Jajce, Ključ, Kotor Varoš, Laktaši, Mrkonjić Grad, Prijedor, Prnjavor, Sanski Most, Skender Vakuf, Srbac, Šipovo andlika Kladuša.

At that time the Archives were also responsible for material from earlier periods consisting of the archive holdings of state authorities, relevant to the banate, districts (in their various historical manifestations and titles) and municipalities and of local interest, archive holdings of municipal and local importance and of socio-political communities and organizations, along with new archive material and registry material from all holders operating in the area for which the Archives were responsible.  The Archives performed their duties pursuant to the Law on Archive Material and the Archives Service of SR Bosnia and Herzegovina.

In late 1975 the Archives had 270 archive holdings and collections extending to 1700 metres of shelving.  Much of the archive material consisted of holdings dating from 1878 or later, with the majority dating from after 1945. The archive material related to the socio-political, economic and cultural development of north-western Bosnia. The material from that period is in Turkish, German, and Serbo-Croat/Croato-Serbian. The oldest surviving document in the Archives dates from 1311, and is housed in the Collection of Oriental Manuscripts.

The majority of the archive holdings were found in the building of the former Royal Banate Authority of the Vrbas Banate in Banja Luka.

The 1992-1995 war in Bosnia and Herzegovina left its mark in many ways on archival activities.  Until mid 1993, the Archives of the Bosnian Krajina with its headquarters in Banja Luka, the Regional Archives in Doboj (founded in 1954), and the Regional Archives in  Fočia (founded in 1976), operated in the area now constituting Republika Srpska.  The Archives of Republika Srpska were instituted pursuant to the Law on Ministries (Official Gazette of Republika Srpska no. 19/93), headquartered in Banja Luka with the status of an independent administrative body of Republika Srpska. Under the terms of the law, the Archives of the Bosnian Krajina in Banja Luka, the Regional Archives in Doboj and the Regional Archives in Foča became part of the Archives of Republika Srpska.

Pursuant to the Law on Cultural Property (Official Gazette of Republika Srpska no. 2/95), Article 64 para. 2, the Archives enjoy the status of a central institute for the protection of cultural property.

Pursuant to Article 40 of the 2002 Law on Ministries, the legal status of the Archives was again changed.  The Archives now became an administrative organization of Republika Srpska as part of the Ministry of Education and Culture, with substantive and territorial jurisdiction over the entire territory of Republika Srpska. The same law also prescribed the responsibilities of the Archives: «The Archives of Republika Srpska exercise professional and other affairs pertaining to:

  • expert supervision of the safe-keeping and protection of registry material and archive material and the selection of archive material from registry material,
  • maintaining records of holders of registry material and archive material and records of registry material and archive material,
  • maintaining accessions and inventory records for each holding and collection,
  • technical and technological measures to protect the archive material,
  • research with a view to completing archive material,
  • compiling scientific informational resources on the archive material,
  • issuing certificates and other documents on facts contained in the archive material,
  • central affairs of archival activities,
  • expert supervision of the work of the archives, scientific research work on archival activities and publication of the results of such work, maintaining records on archives, compiling methodological directives and standards for the professional affairs of the archives, microfilming archive material of particular importance for Republika Srpska in order to preserve it in the event of war or the immediate threat of war,
  • the receipt, safe-keeping, processing and preservation of films and filmed material of historical, artistic, cultural and scientific importance,
  • conducting other general affairs and archival affairs of particular importance for Republika Srpska, with responsibility for retaining and preserving public recoreds and the archival heritage and for ensuring public access to the heritage.» (Official Gazette of Republika Srpska no. 70/02).

Two sectors have been set up in the Archives of Republika Srpska as its basic organizational units:

  • sector for the classification and processing of archive material;
  • sector for the supervision of registry offices, legal and general affairs.

The sector for the classification and processing of archive material is organized as follows:

  • Department for the classification and processing of archive material:

-          Storage and the technical and technological protection of archive material

-          Information and documentation

-          Classification and processing of archive material

-          User services and information

-          Library

 

  • Department for the classification and processing of archive material:

-          Presentation of the archive material and publications

-          Scientific research

-          Cultural, educational and information affairs.

 

Five branch offices operate under the auspices of the Department for the classification and processing of archive material, organized territorially as follows:

1.       Branch office in Doboj,

2.       Branch office in Zvornik,

3.       Branch office in Foča,

4.       Branch office in Trebinje.

 

The sector for the supervision of registry offices, legal and general affairs is organized as follows:

  • Department for the protection of archive material outside the Archives:

-          Registry office supervision

-          Provision of expert assistance to holders of registry material

-          Maintaining records of archive material outside the Archives.

-          General, legal and personnel affairs

The Archives include a library with more than 13,950 titles (books, laws, regulations, periodicals and newspapers) of historical and archival content.

However, after «conducting research and professional valorization,» the Archives of Republika Srpska made a selection and submitted a proposal to the Commission to Preserve National Monuments to designate 24 holdings and collections as national monuments of Bosnia and Herzegovina.

Description of the property: documentation of the National Commission authority Banja Luka extending to the counties of Banja Luka, Prijedor, Bosanski Novi, Bosanska Gradiška, Bosanska Dubica, Sanski Most, Kotor Varoš, Teslić, Tešanj, Prnjavor and Derventa.  Correspondence between the District Commission and certain county commissions and with the National Commission forn BiH. The holdings also includes documents providing information on war crimes in Banja Luka, Prijedor, Bosanska Gradišca, Bosanska Krupa, Bosanski Novi, a list of those killed in the village of Drakulić, a list of persons killed, deceased and missing during World War II in Banja Luka, a study of Jewish victims in Banja Luka, a report on crimes in Ivanjska, and on Ustasha actions in the villages of Drakulić, Motike, Rakovac, Šargovac 7 February 1942.

Description of the property: the material of this holding consists of correspondence between this commission and the National Commission's district body for the Bosnian Krajina and local commissions.  Documents have been preserved on the savagery and looting by the enemy in this area during World War II.  The material contains lists of Ustasha and Chetnik families from the Prnjavor district and a list of Chetniks from Čečava.

19. EXTRAORDINARY PEOPLE'S COURT BANJA LUKA FROM 1941 TO 1942

Description of the property: documentation relating to reports of and court cases against persons causing damage to the state or illegally possessing weapons, records of interrogation of persons reported, rulings on retention of military items, reports of arbitrary confiscation of property belonging to the Serb population, decisions on the allocation of aid to the families of the disabled.

20. BANJA LUKA TOBACCO FACTORY FROM 1888 TO THE PRESENT

Description of the property: documentation relating to the financial affairs of the factory, personal documentation of officials and workers, various applications, receipts, rulings, invoices, contracts and inspections.  The holdings include part of the confidential material of importance for a study of the workers' movement.

21. COLLECTION OF ORIENTAL MANUSCRIPTS AND DOCUMENTS FROM THE 17TH TO THE 20TH CENTURY

Description of the property: the collection consists of various documents dating from the 17th to the 20th century, such as works of philosophy, charters, tapije (Turkish tapu, official document on ownership rights of immovable property) and bujrundije (Turkish buyruldu, order, decree)

22. COLLECTION OF CHARTS AND MAPS SINCE 1807

Date of origin of collection: 1807 to 1980,

Description of the property: the majority of the maps are of a military nature (79), with a smaller number of a geographical, political or technical nature.  The maps relate to Bosnia and Herzegovina, Croatia, Slavonia, Dalmatia, Montenegro and Serbia, and are from Austro-Hungarian, German and Yugoslav sources.

24. COLLECTION OF DOCUMENTS OF THE CENTRAL BOSNIA CHETNIK CORPS FROM 1943 TO 1945

Description of the property: the documents are of a military nature, and describe the actions of the Chetnik brigades, battalions and corps.

3. Legal status to date

The archive holdings and collections of the Archives of Republika Srpska have not previously enjoyed protected status.

 

4. Current condition of the property

The archive holdings and collections of the Archives of Republika Srpska are housed in Aleja Svetog Save st., Banja Luka. The holdings designated as a national monument are housed in two rooms on the ground floor of the building. The Archives building has been recently adapted, and the material is thus housed in good conditions.  It is currently being digitalized.

In 2006 the Archives of Republika Srpska received a fully equipped laboratory for the protection and conservation of archive material as a donation from the Government of Japan. However, although the staff structure provides for the employment of a conservator of archive documents, the Government of Republika Srpska, in the shape of the relevant ministry, has not approved the employment of an additional qualified staff member. The laboratory therefore still remains unused.

 

III – CONCLUSION

 

Applying the Criteria for the adoption of a decision on proclaiming an item of property a national monument (Official Gazette of BiH nos. 33/02 and 15/03), the Commission has enacted the Decision cited above designating the archive holdings and collections of the Archives of Republika Srpska in Banja Luka as a national monument.
