             Pursuant to Article V para. 4 Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina and Article 39 para. 1 of the Rules of Procedure of the Commission to Preserve National Monuments, at a session held from 21-27 January 2003 the Commission adopted a

 

D E C I S I O N

 

I

 

            The historic building of the the Dizdar or Women’s Mosque is hereby designated as a National Monument of Bosnia and Herzegovina.

            The building is situated on c.p. (cadastral plot) 937, c.m. (cadastral municipality) Jajce I, Jajce Municipality, Federation of Bosnia and Herzegovina, Bosnia and Herzegovina.

            The provisions relating to protection and rehabilitation measures set forth by the Law on the Implementation of the Decisions of the Commission to Preserve National Monuments, established pursuant to Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina (Official Gazette of the Federation of  BiH nos. 2/02 and 27/02) shall apply to the National Monument specified in the preceding paragraph.

 

II

 

            The Government of the Federation of Bosnia and Herzegovina shall be responsible for ensuring and providing the legal, scientific, technical, administrative and financial measures necessary to protect, conserve, display and rehabilitate the National Monument specified in Clause I of this Decision.

            The Commission to Preserve National Monuments of Bosnia and Herzegovina (hereinafter: the Commission) shall determine the technical requirements and secure the funds for preparing and setting up signboards with the basic data on the monument and the Decision to proclaim the property a National Monument.

 

III

 

            For the purpose of ensuring the ongoing preservation of the building on c.p. no. 937, all works are prohibited other than works of conservation or restoration to a project approved by the relevant Federal ministry and under the professional supervision of the heritage protection authority of the Federation of Bosnia and Herzegovina.    

            On the adjacent plots c.p. No. 888, 889, 896, 898, 899, 900, 934, 935, 936 no construction shall be permitted other than the reconstruction of war-damaged buildings in accordance with a project approved by the relevant Federal ministry under the professional supervision of the heritage protection authority of the Federation of BiH. Residential buildings are to be reconstructed in their original form, with identical horizontal and vertical dimensions, roof pitch and materials that will not detract from landscape value of the location.

           

IV

 

            All executive and area development planning acts not in accordance with the provisions of this Decision are to be revoked.

 

V

 

            Everyone, and in particular the competent authorities of the Federation of Bosnia and Herzegovina, the Canton, and urban and municipal authorities, shall refrain from any action that might damage the National Monument specified in Clause I of this Decision or jeopardize the preservation and rehabilitation thereof.

 

VI

 

            The Government of the Federation of Bosnia and Herzegovina, the Federal Ministry of Urban Planning and the Environment, the Federation heritage protection authority, and the Municipal Authorities in charge of urban planning and land registry affairs, shall be notified of this Decision in order to carry out the measures stipulated in Articles II, III and IV of this Decision, and the Authorized Municipal Court shall be notified for the purposes of registration in the Land Register.

            The elucidation and accompanying documentation form an integral part of this Decision, which may be viewed by interested parties on the premises or by accessing the website of the Commission (http://www.anek8komisija.com.ba) 

 

VIII

 

            Pursuant to Art. V para 4 Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina, decisions of the Commission are final.

 

IX

 

            This Decision shall enter into force on the date of its adoption and shall be published in the Official Gazette of BiH and the Official Gazette of the Federation of BiH.

                                                            E l u c i d a t i o n

 

I - INTRODUCTION

            Pursuant to Article 2, paragraph 1 of the Law on the Implementation of the Decisions of the Commission to Preserve National Monuments, established pursuant to Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina, a “National Monument” is an item of public property proclaimed by the Commission to Preserve National Monuments (hereinafter referred to as the Commission) to be a National Monument pursuant to Articles V and VI of Annex 8 of the General Framework Agreement for Peace in Bosnia and Herzegovina (hereinafter referred to as Annex 8) and as property entered on the Provisional List of National Monuments of Bosnia and Herzegovina (Official Gazette of  BiH no. 33/02) until the Commission reaches a final decision on its status, as to which there is no time limit and regardless of whether a petition for the property in question has been submitted or not.

            On 27 December 2002 the Commission received a petition from the Islamic Community of BiH, Jajce majlis (council), to designate the property as a National Monument, pursuant to Article V of Annex 8 and Article 35 of the Rules of Procedure of the Commission to Preserve National Monuments

 

II –PROCEDURE PRIOR TO DECISION

            In the procedure preceding the adoption of a final decision to proclaim the property a national monument, the following documentation was inspected:

Ÿ          Data on the current condition and use of the property, including a description and photographs, data of war damage if any, data on restoration or other works on the property if any, etc.

Ÿ          Documentation on the location and current owner and user of the property (copy of cadastral plan and copy of land registry entry)

Ÿ          Historical, architectural and other documentary material on the property, as set out in the bibliography forming part of this Decision.

 

            The findings based on the review of the above documentation and the condition of the property are as follows:

 

Information on the Site

Location

            The Dizdar or Women’s Mosque is located in the upper part of town known as Gornja Mahala, immediately beside the Jajce citadel, Starogradska street c.p. 937, c.m. Jajce I, and is owned by the United Vakuf (Waqf) of the Islamic Community of BiH (IVZ),  Federation of BiH, Bosnia and Herzegovina.

Historical information

            The mosque was built by Sulejman-bey Kulenović in 1812/13.  The year of construction was recorded on a chronogram above the portal that survived until 1992. The chronogram measured 40 x 96 cm, and was carved in Arabic prose.  The year was not written in numerals, but was said to be in the form of an abjad where letters stand for numbers.  The total value of the letters was 1277, indicating that this was the hijra year, which corresponds to 1812/13 CE.  It is not known from the chronogram whether there was an earlier mosque on the site (Mujezinovic, 1998, p. 272)

 

Legal status to date

            By Ruling of the Institute for the Protection of the Cultural, Historical and Natural Heritage of Bosnia and Herzegovina No. 144/51, the Property was place under state protection.

            The mosque forms part of the urban ensemble of Jajce, which the Regional Plan for Bosnia and Herzegovina to 2002 recorded as a category 0 ensemble, or an ensemble of international importance.

 

2. Description of the Monument

            The Dizdar Mosque in Jajce belongs to the typological series of central single-space mosques without sofas and minaret,  with a masonry dome concealed by a tent-like hipped roof. The Sinan-bey (Okić) Mosque in Jajce, which is located in the immediate vicinity of the Dizdar Mosque, has the same typological disposition, which is not common in Bosnia and Herzegovina.

            The whole interior space is vaulted by a stone dome on trompes 4.45 above floor level.  Tuff was used to build the dome and trompes.

            The external dimensions of the building are 5.70 x 6.60 x 6.45. The height is adapted to the pronounced slope of the terrain. The walls vary in thickness from some 65 cm on the east to 75 cm in parts o f the west wall.  Both the interior and exterior facings of the walls are ashlar limestone with lime mortar binding, with an infill of quarry limestone in lime mortar. There are three small windows on the west side, roughly square in shape, measuring 78 x 90 cm, with wrought iron bars.  On the east wall there was a walled in aperture measuring 88 x 110 cm. The entrance to the mosque is through an arched portal with the lintel and jambs made of dressed limestone. The arched lintel is made of a single piece of stone. Above the portal there was a chronograph that was removed during the 1992-1996 war.

            In the interior of the property is a well-made tuff mihrab with three rows of stalactites. The mihrab measures 75 x 210 cm, with a depth of 50 cm. The interior of the mosque was plastered and decorated with traditional floral motifs of garlands and leaves.  The building had a steeply pitched hipped roof, like the surrounding houses, with a covering of chestnut-wood shingles. The mosque did not have a minaret.

 

3. Research and Conservation and Restoration Works

            The property remained in its original condition until 1992. Minor repairs were carried out on the roofing and interior of the property on the initiative of the local inhabitants. During the 1960s, the north-east window was walled in.

            The Institute for the Protection of the Cultural, Historical and Natural Heritage of Bosnia and Herzegovina conducted a detailed survey of the site in 2001, and a Reconstruction Project was drawn up in July 2001. The project is currently being implemented with the help of the Swedish Foundation CHwB.

 

4. Current Condition of the Site

            The building was reconstructed during 2002, when the walls and the dome were reconstructed, the roof structure and joinery were made, and work on the interior was carried out (wall plastering.)

            Prior to reconstruction, the building was in very poor condition as a result of long exposure to rain, snow and frost, which led to damage to the lime plaster within the structure and and the upper reaches of the stone walls and the dome. 

 

III - CONCLUSION

            Applying the Criteria for the adoption of a decision on proclaiming an item of property a national monument, adopted at the fourth session of the Commission to Preserve National Monuments (3 to 9 September 2002), the Commission has enacted the Decision cited above.
